Advanced Trees Terms of Sale

These are the terms governing all orders for the purchase of advanced trees from East Coast Palms and Plants:

  1. Availability/Ordering: Quoted tree prices will remain valid for 14 days. The trees referred to in this quotation are presently available. However, no trees can be allocated to the Customer until the Supplier receives a written order addressed to East Coast Palms Pty Limited and signed by or on behalf of the Customer, along with a non-refundable deposit equal to 50% of the ordered tree component and associated GST.

  2. Suitability for purpose prior to ordering, customers may inspect and select trees at the Supplier’s associated nursery. Customers are encouraged to visit and ensure suitability, particularly regarding species, size, and form. Failure to do so authorizes nursery staff to select the best available trees to fulfill the order.

  3. Payment: payment must be made prior to delivery.

  4. Progress Payments: In the absence of any contrary agreement: For delivery scheduled between six and 12 months from the order date, a second progress payment of 25% of the ordered tree component plus associated GST is due after six months. If any trees remain unclaimed after 12 months, a third progress payment of 25% of the remaining ordered tree component plus associated GST is required. 

  5. Tree Size: Any quoted dimensions are indicative. Variations are expected, particularly for non-immediate deliveries. Sizes and pricing may increase due to delayed delivery.

  6. Transport: If the Supplier arranges transportation: 6.1 Loading will occur under the supervision of the Supplier’s staff and carriers, with ownership and liability transferring to the Customer upon exit from the nursery gates. 6.2 Freight charges are estimated based on travel times and a maximum of 1 hour on site at drop-off. Additional charges may apply for extended unloading times or changes in delivery logistics. 6.3 Freight quotations may be revised if carrier rates increase, delivery is deferred, or delivery logistics change. 6.4 The Customer must ensure safe access and space for delivery, provide adequate assistance for unloading, and address any safety hazards. Failure to do so may result in additional charges.
